1. Introduction and Acceptance of Terms

  • 1.2. Agreement to Terms: Clearly state that by accessing or using the Freecourse website, its services, content, and courses (collectively, the “Services”), you agree to be bound by these Terms and Conditions (“Terms”), our Privacy Policy, and any other policies referenced herein. If you do not agree to these Terms, you may not access or use the Services.
  • 1.3. Modifications to Terms: State that Freecourse reserves the right to modify these Terms at any time. All changes will be effective immediately upon posting on the website. We will notify users of significant changes through prominent notices on the website or via email. Your continued use of the Services after such modifications constitutes your acceptance of the revised Terms.

2. User Accounts

  • 2.1. Account Creation: To access courses, you must create a user account. You agree to provide only a valid email address during the registration process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • 2.2. Account Security: You agree to notify Freecourse immediately of any unauthorized use of your account or any other breach of security. Freecourse cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.
  • 2.3. Age Restrictions:
    • Students: Anyone may register as a student to watch courses.
    • Instructors: To become an instructor, you must be 18 years of age or older. By registering as an instructor, you represent and warrant that you are 18 years of age or older.
  • 2.4. Account Termination/Suspension: Freecourse reserves the right to terminate or suspend your account, access to Services, or course enrollments at its sole discretion, without prior notice, for any violation of these Terms or for any other reason, including if we believe your actions may cause legal liability for us, our users, or instructors.

3. Instructor-Specific Terms (for Instructor Content)

  • 3.1. Becoming an Instructor: If you wish to become an instructor, you must contact Freecourse via the “contact” tab for an approval process.
  • 3.2. Instructor Content Ownership: Instructors retain all ownership rights to their course content (“Instructor Content”). By publishing Instructor Content on Freecourse, you grant Freecourse a limited, non-exclusive, worldwide, royalty-free, transferable, and sublicensable right to host, display, offer, market, promote, sell, and sublicense your Instructor Content to students on the Freecourse platform. This license is solely for the purpose of operating and promoting the Freecourse platform and its services.
  • 3.3. Instructor Responsibilities: Instructors are solely responsible for the quality, accuracy, legality, and appropriateness of their Instructor Content. This includes ensuring all content, including external video links, respects copyright and intellectual property rights. Freecourse is not responsible for any issues arising from Instructor Content.
  • 3.4. Content Moderation & Deletion: Freecourse reserves the right to review, edit, remove, or refuse to host any Instructor Content at its sole discretion, especially if it is deemed to violate these Terms, including but not limited to copyright infringement claims. If a course is found to be violating copyright, it will be deleted.

4. Course Access and Licensing (for Students)

  • 4.1. Course Purchase/Enrollment: Courses are offered for unlimited access after a one-time purchase. For subscription-based access, access is granted for the period of the subscription.
  • 4.2. License to Students: Upon purchase or valid subscription, Freecourse grants you a limited, non-exclusive, non-transferable license to access and view the course content solely for your personal, non-commercial, educational purposes.
  • 4.3. Prohibited Uses by Students: You agree not to reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer or use any course content unless explicitly authorized by these Terms or the course instructor. This includes downloading materials if not explicitly permitted by the instructor.
  • 4.4. Certificates of Completion: Upon successful completion of a course, Freecourse may issue a certificate of completion. These certificates signify completion of the Freecourse course only and are not professional certifications unless explicitly stated within the course description by the instructor and verified by external accreditation if applicable.

5. Payments, Pricing, and Refunds

  • 5.1. Pricing: Course prices are generally low (e.g., maximum 10$) and are subject to dynamic pricing, discounts, and promotions at Freecourse’s or the instructor’s discretion. All prices are displayed in [Currency, e.g., Euro or USD].
  • 5.2. Taxes: A 20% tax will be applied to each course purchase, which will be clearly visible during the payment process.
  • 5.3. Refunds: Due to the low pricing structure, Freecourse offers a limited refund policy. Refunds are granted at the sole discretion of Freecourse, generally only in cases of technical issues preventing course access that cannot be resolved. All refund requests must be made via the “contact” tab and will be assessed on a case-by-case basis. 6. User Conduct and Prohibited Activities

  • 6.1. General Rules of Conduct: You agree to use the Services in compliance with all applicable laws and regulations and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Services by, any third party. This includes adhering to general rules of online etiquette and respect.
  • 6.2. Prohibited Behaviors: You are strictly prohibited from engaging in any of the following activities:
    • Uploading or sharing content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
    • Harassing, abusing, or harming another person or group.
    • Impersonating any person or entity.
    • Attempting to gain unauthorized access to any portion or feature of the Services, or any other systems or networks connected to the Services.
    • Interfering with or disrupting the integrity or performance of the Services or the data contained therein.
    • Introducing any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
    • Scraping, crawling, or using any automated means to access or collect data from the Services without express written permission.
    • Engaging in any activity that could be considered spamming or phishing.
    • Plagiarism or cheating, including sharing course answers or attempting to misrepresent your completion of a course.
  • 6.3. Consequences of Violation: Any violation of this Section may result in immediate suspension or termination of your account, removal of content, and/or other legal action.

7. Intellectual Property

  • 7.1. Freecourse’s Intellectual Property: All intellectual property rights in and to the Freecourse platform, its design, logos, software, underlying technology, and all content created directly by Freecourse (excluding Instructor Content), are owned by Freecourse or its licensors.
  • 7.2. User-Generated Content (UGC): If a course allows users to upload content (e.g., comments, reviews, project submissions), the instructor manages the settings for what content is allowed. By uploading such content, you grant Freecourse a worldwide, non-exclusive, royalty-free, perpetual, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any form, media, or technology, for the purpose of operating, improving, and promoting the Services. You represent and warrant that you have all necessary rights to grant us this license.
  • 7.3. Copyright Infringement Policy: Freecourse respects the intellectual property rights of others. If you believe that any content on the Freecourse platform infringes your copyright, please notify us immediately via the “contact” tab with detailed information. Upon receipt of a valid claim, Freecourse will promptly investigate and, if the course seems to be violating copyright, it will be deleted.

8. Disclaimers and Limitation of Liability

  • 8.1. “As Is” Basis: The Services, including all courses and content, are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • 8.2. No Guarantees: Freecourse makes no guarantee that: (a) the Services will meet your specific requirements; (b) the Services will be uninterrupted, timely, secure, or error-free; (c) the results that may be obtained from the use of the Services will be accurate or reliable; or (d) the quality of any products, services, information, or other material purchased or obtained by you through the Services will meet your expectations.
  • 8.3. Instructor Content & External Links: Instructors are solely responsible for the content of their courses, including any external links they provide. Freecourse does not endorse, verify, or guarantee the accuracy, quality, or legality of any Instructor Content or content from external links. You acknowledge and agree that your reliance on any Instructor Content or external links is solely at your own risk.
  • 8.4. Limitation of Liability: To the fullest extent permitted by applicable law, in no event shall Freecourse, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
  • 8.5. Our Best Efforts: We commit to doing our best to ensure courses maintain a good level and services are top-notch, but this does not constitute a warranty or guarantee of specific outcomes.

9. Governing Law and Dispute Resolution

  • 9.1. Governing Law: These Terms shall be governed and construed in accordance with the laws of France, without regard to its conflict of law principles.
  • 9.2. Dispute Resolution: In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, the parties shall first attempt to resolve the matter informally through good faith negotiation. If a dispute cannot be resolved informally, it shall be submitted to the competent courts of France.
  • 9.3. Class Action Waiver: You agree that any disputes with Freecourse will be conducted on an individual basis only and that you will not participate in any class action or representative action against Freecourse.

10. Privacy
